Unregistered Flats Row: What It Means for Buyers in Greater Noida West

The Allahabad High Court has asked the state government, GNIDA and UP-RERA what action they have taken on flats that cannot be registered over a builder's unpaid dues. For buyers in leased group-housing land, it is a reminder that full payment and possession do not always mean registered ownership.

What happened?

The Times of India reported that the Allahabad High Court called it strange that buyers who have paid in full cannot get their homes registered because a developer has not cleared dues to government agencies. The case comes from a plea by residents of Ajnara Homes in Greater Noida West.

According to the paper, 20 residents petitioned the court in April. They said they had paid fully and taken possession but still lacked sole ownership, could not sell, and faced steep transfer charges from the developer when a sale did go through. GNIDA told the court it had held back registries because APV Realty Limited owed Rs 60 crore, which rose to Rs 84 crore with GST and penal interest.

On Oct 7, a bench of Justices Siddhartha Varma and Ram Manohar Narayan Mishra directed that the action taken by the government, and by RERA, be placed on record. TOI said possession of around 2,200 flats was given in 2018, yet registries for only 1,592 units are done. The next hearing is on Oct 30. Homebuyer groups quoted by TOI estimate around 75,000 such unregistered flats across Noida and Greater Noida.

Which sectors are affected?

  • Greater Noida West
  • Greater Noida
  • Noida
  • Group-housing societies on authority-leased land
  • Ajnara Homes

Potential impact

The order itself is a request for information, not a ruling on who pays or when registries resume. Nothing in the report says the registries will be released soon, so prices in affected societies are unlikely to shift on this news alone. Any change would depend on how the dues are settled and what the next hearing brings.

Over time, flats that cannot be registered tend to trade at a discount to comparable registered ones, because lenders and buyers are wary of unclear title. If the authorities separate buyers' registries from recovery of builder dues, as a committee reportedly recommended, that discount could narrow. That remains a recommendation, and no such rule has been announced. For context, our data puts the average Greater Noida price at Rs 7,800 per sq ft.
