The Times of India reported that the Telangana High Court cancelled the acquisition proceedings for a proposed township in Tellapur, started with a notification in 2006 and a declaration in 2007. Justice Vakiti Ramakrishna Reddy found fault with both the procedure and the substance of the exercise. The land covers 92.39 acres, which the district collector was to take over for HUDA, now HMDA.
According to The New Indian Express, the court called the stated purpose too imprecise for landowners to file meaningful objections. It also found that the Section 5-A hearing had become an empty formality, and that no record showed the government itself forming the opinion required under the 1975 urban development law. The Times of India added that the same notification had already been struck down in February for part of this land, and the court saw no reason to treat the remaining owners differently.
The Times of India said the 92.39 acres are part of a 326.37-acre parcel that once belonged to a housing cooperative for industrial employees. Petitioners said the land was converted to non-agricultural use in 1986, divided into plots, and dropped from acquisition in 1989. The state and HMDA argued that township development is a valid public purpose and that interim court orders caused the delay. The court allowed the six petitions but left the authorities free to begin fresh proceedings, provided they follow the law strictly.
