SRA Hearing Rule: What It Means for Investors in Mumbai Private Land

ET Realty reported that Mumbai's Slum Rehabilitation Authority must now notify private landowners and hear them before a slum declaration on their plots. That cuts the chance of a sudden tag freezing a sale or redevelopment.

What happened?

ET Realty reported that the Slum Rehabilitation Authority (SRA) in Mumbai has changed its procedure for private land. Earlier, a notification alone was enough once land was treated as a slum area and a rehabilitation scheme could begin.

Under the new notification, as described by ET Realty, a landowner gets a written notice of the proposed declaration under Section 3C of the Maharashtra Slum Areas Act. The owner has 30 days to object and can seek a personal hearing before the SRA chief executive. A public notice will also be issued.

According to the same report, the earlier rule of 2022, which treated land with slums as on 1 January 2011 as a rehabilitation area by default, has been removed. ET Realty also noted that the Bombay High Court and the Supreme Court had earlier leaned towards giving landlords a say.

Which sectors are affected?

  • Mumbai private land with slum occupation
  • Slum rehabilitation schemes
  • Land and redevelopment owners
  • Plot and redevelopment investors

Potential impact

The main change is procedural. An owner who is told early and heard can contest a tag, correct the record or negotiate a scheme, instead of finding out after the declaration. That should lower one specific risk for private plots: a status change that stalls a sale, a loan or a redevelopment approval.

It does not clear slums from any plot or change who is entitled to rehabilitation. The hearing window may also add time before schemes begin. With Mumbai's average price near 32000 per sq ft in our data, even short delays on a plot can be costly, so outcomes will vary by site and by how the authority applies the rule in practice.
