What happened?

The Tribune reported that HARERA Gurugram, under Chairman Arun Kumar, decided 26 complaints against Agrante Realty in a single order. Mohd Imran's complaint was treated as the main one, and its outcome was extended to the remaining allottees. They had approached the authority for delay possession charges and interest after their flats were not delivered on schedule.

According to the report, the authority fixed the possession deadline at August 20, 2023. It counted four years from the clearance of August 20, 2019, as the Affordable Housing Policy, 2013 requires. The Tribune said the promoter has not secured an occupation certificate and has not offered possession.

Agrante cited the pandemic, a state moratorium, GRAP-linked construction bans, court orders and labour and material shortages, and sought time until March 2026. The Tribune reported that the authority rejected these pleas, saying such bans should have been foreseen and that the whole group of buyers should not bear the cost of a few defaults. The builder has 90 days to comply.

Which sectors are affected?

  • Gurugram affordable housing
  • Delayed-possession buyers
  • Agrante Realty's Kavyam project
  • Real estate regulation in Haryana

Potential impact

The order does not change market prices directly. Its main effect is on the cost of delay for a promoter, and on the confidence of buyers who are waiting for possession in other affordable projects. If other benches follow the same reasoning, builders may find that pandemic and pollution-ban arguments carry less weight.

The outcome for Kavyam buyers still depends on compliance. Interest is adjusted against dues, possession follows only after an occupancy certificate, and any separate compensation claim must go to the adjudicating officer. Builders may also appeal, so actual payouts and timelines remain uncertain.
