What happened?

The Times of India reported that the Bombay High Court quashed stamp duty demands running into crores against firms involved in Goregaon property transactions. Justice Amit Borkar, sitting singly, ruled on Oct 5 and disposed of four petitions in one judgment. They challenged an order of March 3, 2016 by the deputy controller of stamps in Mumbai.

According to the newspaper, the case concerned land at Laxmi Industrial Estate, Village Pahadi, which had been declared a slum in 1977. Development-cum-sale agreements were signed in 1985 for five plots over 8,400 sq metres, with stamp duty of Rs 40,000 paid at the time. After the SRA asked the petitioners in 2012 to establish their title, four conveyances were prepared. The stamp authorities then valued the land at over Rs 56 crore as of 2012 and sought duty of over Rs 2 crore.

The Times of India said the court found continuity in the parties, the properties and the rights across the old agreements and the 2012 conveyances. It held that the authorities were wrong to treat the later documents as a fresh sale and to apply 2012 values. Because of that finding, the court did not decide whether the 2012 ready reckoner could be used.

Potential impact

The ruling's main effect is on how stamp authorities read a chain of documents. If a final conveyance simply completes a transfer agreed years earlier, duty may be assessed on the earlier arrangement and not on the market value at the date of the last document. For long-delayed redevelopment projects, that could mean a lower duty bill and fewer disputes at the completion stage.

This is a single-judge decision on four petitions with specific facts, including possession papers, powers of attorney and receipts that tied the documents together. It does not change ready reckoner rates, and it does not make every late conveyance exempt from fresh duty. The court itself said there must be material showing how the documents connect. Mumbai's average of Rs 32,000 per sq ft in our data is not affected directly; the effect is on transaction cost and legal risk in older, layered deals.
