Bombay HC Quashes CIDCO Transfer Charge: What It Means for Buyers in Nerul Societies

The Bombay High Court has set aside CIDCO's Rs 24.58 lakh transfer demand on a Nerul society, but only for two societies with leases that predate 1990. Other societies must still prove their own case.

What happened?

Mid-Day reported that the Bombay High Court cancelled a transfer-charge demand of Rs 24.58 lakh that CIDCO had raised on Manmandir Cooperative Housing Society in Nerul. Matching demands connected to Surya Cooperative Housing Society in Vashi were also set aside. CIDCO had first sent the notice to Manmandir in 2016, covering transfers involving 27 flats.

According to Mid-Day, the bench held that a rule added to the 1975 land disposal regulations in February 1990 could not be pushed back onto leases signed before that date, because those leases carried no such obligation. CIDCO had argued that the levy recovers unearned gains when flats built on concessionally allotted land are resold. The court did not accept that this could create a fresh liability after the fact.

The relief is narrow. Mid-Day said the court neither struck down the regulation nor granted a blanket exemption. A federation of Navi Mumbai housing societies had sought a wider declaration, but the court was not given the lease papers and details it needed, and thirteen listed societies were left out because only their names were on record. Mid-Day added that a senior CIDCO official, who asked not to be named, said the corporation had not yet received the order and would study it before commenting.

Potential impact

For the two societies concerned, a large pending demand has gone, which removes a cost that could have been passed on to members at the time of a transfer. Where members were holding back from selling or from conveyance and lease registration because of an unresolved charge, that hesitation may ease. Even here, CIDCO could still challenge the order, and it had not commented when Mid-Day published.

For other societies the picture is less certain. The order is a useful reference, not a rule that covers everyone, and each society's own lease terms and dates will decide the outcome. Any effect on resale prices or redevelopment costs is likely to be gradual and uneven, and it depends on whether CIDCO accepts the reasoning or the federation has to go back to court.
